The murder trial for the murder of Scone meat worker Jesus Babita began yesterday in the Newcastle Supreme Court.
Work colleague Jamie Cust is facing trial for the murder of Mr Babita which occurred in December 2018 in Scone.
Mr Cust yesterday in court, to face the charge, entered a plea of not guilty.
It was reveled in the Court that Mr Babita had been stabbed 49 times. Mr Cust's Barrister told the Court his client doesn't deny stabbing the victim, but claims he was operating under extreme provocation.
Mr Cust who had called his Step-Father to pick him up after the event said he told him on the trip home he had stabbed Mr Babita because he tried to rape him. Mr Cust's Step-Father encouraged him to go to the police. Mr Cust repeatldy replied: "I can't. I don't want to go to jail".
Police once told of the incident went to the Scone address and found the body of Mr Babita lying in a pool of blood. Police also discovered that one of the bedrooms had been set on fire.
The murder trial is set to continue in the Newcastle Supreme Court.
