A Sydney court has dismissed an application by a sacked Upper Hunter Shire councillor to review her removal from the elected role.
Elizabeth Flaherty, through a legal representative, told the Civil and Administrative Tribunal yesterday it had jurisdiction to conduct a hearing to determine if the action was unlawful.
The council and Office of Local Government both argued there was no decision made to review because it just happened automatically under the act.

Principal Member Theresa Simon initially reserved her decision before ruling against the former councillor.
