Feedback open on proposed changes to NSW noise regulation

Public feedback is being sought on proposed updates to the state’s Noise Control Regulation, with the NSW Environment Protection Authority inviting comments on a draft released for consultation.

The regulation sets out rules for managing common neighbourhood noise sources, as well as motor vehicles and marine vessels. It does not cover construction or entertainment noise, which are regulated separately.

The EPA is proposing several major changes, including increasing penalties for offensive noise and extending the permitted hours of use for equipment such as air conditioners and pumps. Under the draft proposal, all restrictions on the use of air conditioners would be lifted during declared severe or extreme heatwaves.

Views are also being sought on extending liability for offensive noise from vehicles used on private property, as well as increasing the time frame regulators have to investigate and issue penalties.

Public consultation on the draft Noise Control Regulation 2026 is open until Wednesday 11 March. Feedback can be submitted through the EPA’s Your Say website.
